The following General Terms and Conditions apply to all legal transactions concluded between the tenant(s) and/or customer(s) and Camping Resort Riegersburg (Vulkanlandcamping Riegersburg GmbH) as the lessor. Any deviating unilateral provisions of the tenant, in particular the tenant’s own general terms and conditions, shall have no legal effect.
RENTAL OBJECT:
As defined in the rental agreement, the rental object includes either a pitch, a caravan with awning, a mobile home, a camping barrel or a glamping tent, each with the corresponding inventory. The rental object may only be used by the persons listed in the rental agreement. Upon receipt of the travel documents, the tenant is responsible for checking that all information corresponds to the booked trip. In case of doubt, the campsite must be contacted. A specific agreement between the lessor and the tenant regarding the exact allocation of a rental object during booking is possible subject to availability. The lessor reserves the right, without stating reasons, to provide a substitute rental object of the same size, at the agreed rental price and time. In such a case, the tenant shall have no claims for compensation against the lessor.
A rental object may be booked bindingly by the tenant electronically, in writing, by telephone or online. By making a binding booking, the tenant submits a valid offer. The tenant is obliged to provide all required information completely and truthfully. The contract is concluded once the booking confirmation (acceptance) has been sent to the tenant by the lessor in writing or electronically.
Smoking is NOT permitted in mobile homes, caravans, camping barrels and tents!
RENTAL PRICE:
The rental price does not include local tourist tax, any registration fees or other charges imposed by the campsite (e.g. waste disposal, pet fees, etc.).
PETS:
Pets are only permitted in rental objects designated for this purpose. Campsite fees for pets must be paid separately at the campsite. Pets must be declared at the time of booking. Pets may not be left unattended in or at the rental object. A maximum of two pets per rental object is permitted.
For mobile homes, rental caravans, camping barrels and rental tents:
Pets are not allowed in the beds. The tenant must bring their own sleeping blanket, food bowl, etc. An additional cleaning fee of €20 per pet will be charged.
TENANT:
The minimum age for tenants is 18 years. The tenant must be present on site for the entire rental period. The tenant is liable for the accuracy of the information provided in the rental agreement. The sole presence of persons under the age of 18 is not permitted and may result in eviction from the campsite. Parents are liable for their children.
REBOOKINGS:
A rebooking exists if the tenant changes the rental object, rental period, dates, type of accommodation, season, or main tenant. Each rebooking will be charged at €15. Any financial disadvantages incurred by the lessor as a result of the rebooking are subject to the cancellation conditions under section CANCELLATION. Rebookings are only possible within the current season. Rebookings to the following season are not possible.
TAKEOVER OF THE RENTAL OBJECT:
The rental object may be occupied from 4:00 p.m. local time (pitches from 2:00 p.m.), unless otherwise stated on the voucher. The tenant is obliged to treat the rental object properly and with care. When leaving the rental object, it must be secured against storms (close windows, caravan door and awning). Awning fixings such as pegs and ropes must also be checked for storm safety.
RETURN OF THE RENTAL OBJECT:
The rental object must be vacated by 10:00 a.m. local time (pitches by 12:00 noon), unless otherwise stated on the voucher. Water canisters and, if applicable, waste water containers must be emptied; dishes washed and put away; dishwasher emptied; refrigerator emptied; waste disposed of; chemical toilets emptied and cleaned; rental object locked; tables, chairs and sun umbrellas placed as found upon arrival; awning closed; keys returned. The tenant is obliged to check and sign the handover protocol properly.
EARLY ARRIVAL / LATE DEPARTURE:
Exceeding these times will result in the charging of an additional overnight fee. The tenant must also indemnify and hold the lessor harmless against any claims for damages by subsequent tenants.
CAMPSITE RULES:
The tenant is contractually bound to comply with the campsite rules. Violations may result in eviction from the campsite. No claims against the lessor may be derived from this. There is no legal entitlement to a specific pitch regarding location, size, condition, etc. Seasonal and infrastructure-related fluctuations in water and electricity supply may occur. WLAN and TV reception cannot be guaranteed. The rental agreement usually includes one parking space for one car (for mobile homes, rental caravans, camping barrels and rental tents: no camping vehicles). The parking space is not necessarily located next to the rental object and will be assigned by the campsite. The erection of additional tents of any kind is not permitted. The tenant acknowledges that instructions from campsite staff must be followed, otherwise eviction may occur.
RENTAL CARAVANS WITH AWNING & RENTAL TENTS:
It is not permitted to remove parts of the tents or the storm safety equipment.
LIABILITY:
The tenant is liable for damages caused by them. The lessor is not liable for the tenant’s personal belongings, vehicles, bicycles, etc. (e.g. theft or natural events). The lessor is liable for damage to the tenant’s property only if caused by gross negligence on the part of the lessor.
ACCIDENTS:
In the event of any accident, the lessor must be informed immediately. The names of witnesses must be recorded. The tenant is not entitled to anticipate decisions of the lessor or the insurance company by acknowledging claims of the injured party. The lessor is not liable for repatriation of the tenant.
SUBLETTING:
Subletting the rental object to third parties by the tenant is prohibited.
WITHDRAWAL BY THE LESSOR:
If the rental object is unavailable through no fault of the lessor (e.g. breakdown, storm damage, fault of previous tenant, etc.), the lessor has the right to provide a substitute rental object of the same size at the agreed price and time, or to withdraw from the contract. All advance payments and deposits shall be refunded. The tenant has no claims for damages. If the contract or agreed services become impossible due to political or legal changes or breach of contract by a partner of the lessor, the lessor cannot be held liable. If only parts of the contract are affected, the remaining services remain valid.
INTERRUPTION OF TRAVEL:
Please report immediately to the lessor’s representative on site and confirm that you are ending your stay. Only valid if an in-house cancellation package has been concluded: in the event of illness or accident, a detailed medical certificate or accident report must be obtained at the holiday destination. These conditions also apply to delayed arrival.
COMPLAINTS:
Any defects must be reported immediately on site so that improvements can be made. Complaints reported only after departure cannot be considered. Complaints must always be recorded on site. Facilities and activities on and around the campsite may be limited or completely closed, especially during pre- and post-season. The campsite cannot be held liable for this.
FORGOTTEN ITEMS:
The lessor is not liable for items forgotten by the tenant. If items are found, they will be sent to the tenant at the tenant’s expense upon request. All costs and risks (damage or loss) are borne by the tenant.
CRIMINAL LAW / CUSTOMS LAW:
The lessor is not liable for violations of criminal or customs law committed by the tenant.
GAS:
The lessor assumes no liability for improper handling by the tenant.
CANCELLATION:
If no in-house cancellation package has been concluded, the following cancellation fees apply:
- Cancellation up to 60 days before start of rental: 20% of the rent
- Cancellation up to 30 days before start of rental: 50% of the rent
- Cancellation from 29 days before start of rental: 90% of the rent
- Cancellation from 3 days before start of rental: 100% of the rent
Cancellations must be reported immediately and in writing. Subsequent claims for recourse are excluded.
PAYMENT TERMS:
A deposit of 20% of the total amount is due within 14 days. The remaining balance must be paid no later than 5 weeks before arrival. If no deposit or balance is received, the lessor reserves the right to cancel the booking at the tenant’s expense. For short-term bookings, the total amount is due immediately upon receipt of the booking confirmation. The rental object will only be released for use after full payment has been received.
ENTRY REGULATIONS:
The tenant is responsible for ensuring that all entry and transit regulations for Austria and transit countries are complied with and must obtain timely information from the relevant embassy or consulate.
SURROUNDINGS OF THE CAMPSITE:
Distances to town centers, shops, beaches, etc. are approximate and may vary depending on the location of the accommodation. Photos and floor plans are symbolic and representative of the booked type. Deviations are possible.
RIGHT OF WITHDRAWAL:
For contracts concluded by electronic, telephone or online bookings outside the business premises, there is no statutory right of withdrawal pursuant to § 18 para. 1 no. 10 FAGG.
DATA PROTECTION:
The customer agrees that personal data (name, address, date of birth, telephone number, fax number, bank details) may be stored by the lessor for the purpose of processing the booking, insofar as this is necessary. The customer has the right at any time to request information about stored personal data. Requests must be made in writing and identity must be proven. The customer also has the right to request correction or deletion of personal data with justification. Requests for deletion must be sent by email to info@riegersburg-camping.com or in writing, stating name, address and reason. Personal data will only be passed on to third parties if required for contract processing, required by law, or explicitly consented to by the customer. If data use is not legally required, the data subject has the right to object to the use of their data due to overriding legitimate confidentiality interests.
PLACE OF JURISDICTION:
Austrian law applies exclusively. The competent District Court of Feldbach has jurisdiction over all disputes arising from this contractual relationship.
ELECTRIC CARS:
Charging electric vehicles at the rental objects is not permitted. Public charging stations must be used.
SEVERABILITY CLAUSE:
Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic intent of the parties. The same applies in the event of gaps in the GTC.
